Answer five questions about weight, commerce, passengers and hazmat to see which federal motor carrier obligations apply to a vehicle — and which ones people commonly assume apply but do not.

1 — Commerce

Does the vehicle operate in interstate commerce? Interstate includes crossing a state line, and carrying goods or passengers that are part of a journey continuing across a state line — even if your truck never leaves the state. This catches more fleets than people expect.

2 — Weight

Highest GVWR or GCWR, whichever is greater Rating from the manufacturer's plate, not what the vehicle happens to weigh today. If it tows, use the combined rating.

3 — Passengers

Is the vehicle designed or used to carry passengers?

4 — Hazardous materials

Does it carry hazmat in quantities requiring placards? Municipal fleets hit this more often than they realise — bulk fuel transfer tanks, some pool chemicals, and certain pesticide loads can require placarding.

5 — Operating radius

Do drivers stay within a 150 air-mile radius and return to the same reporting location within 14 hours? This is the § 395.1(e) short-haul exception. It changes the logging obligation, not whether the safety rules apply.
